Maternity Leave in California at a New Job (Less Than 12 Months)
Starting a new job and finding out you're pregnant is common. So is the panic that comes with hearing "you need 12 months for leave." That rule is real, but it only applies to one part of your leave.
What you still get
- PDL job protection: no minimum time at your job. If your employer has 5 or more employees, your job is protected for up to 17.3 weeks while your doctor says you can't work.
- SDI pay: based on wages from a past window of time, called your base period. Wages from your old job can count.
- PFL pay: you can still file and get paid for up to 8 weeks of bonding.
What may change
CFRA protects your job during bonding time. It needs 12 months and 1,250 hours at your employer. If you don't have that yet, your bonding weeks are paid through PFL but not automatically job-protected.
How parents typically handle it
Many employers grant a protected leave of absence anyway. Go to HR with your dates and a clear plan. Companies typically appreciate parents who bring the California details with them.
Timing can help
If you'll hit 12 months during your disability leave, your CFRA eligibility may be counted at the start of bonding. Map your dates early so you know where you stand.
