California Parental Leave, Explained

Your HR packet says 12 weeks. That's the federal minimum, not the California total.

California runs the most generous paid parental leave system in the country. Used in the right order, its programs can give you up to 29 weeks of leave, with up to 25 weeks paid at 70 to 90% of your income.

If you're a W-2 employee in California, you've already paid into this. The CASDI line on your paystub is what funds it.

The 4 programs

Two programs pay you. Two protect your job.

The ones that pay you

SDI (State Disability Insurance) Paid

Pays the birthing parent during pregnancy and recovery. It typically starts up to 4 weeks before your due date and runs 6 to 8 weeks after birth.

PFL (Paid Family Leave) Paid

Pays any parent for up to 8 weeks to bond with a new child, whether by birth, adoption or foster placement.

The ones that protect your job

PDL (Pregnancy Disability Leave) Job-protected

Up to 17.3 weeks of job-protected time for the birthing parent.

CFRA (California Family Rights Act) Job-protected

Up to 12 weeks of job-protected bonding time for any parent.

Why the order matters

Each program has its own forms, timing and rules. SDI is typically filed within 9 calendar days after your last day of work. For the birthing parent, PFL starts after SDI ends. Your employer's pay policies have to fit around both.

Families typically report working out the order after the deadlines had already passed.

Common questions

Is parental leave paid in California?

Yes. SDI and PFL replace up to 70 to 90% of your income, depending on your earnings.

Do partners and dads get paid leave?

Yes. Any parent can claim up to 8 weeks of PFL to bond with a new child.

Does my employer have to hold my job?

PDL and CFRA protect your job at employers with 5 or more employees. CFRA also requires 12 months and 1,250 hours worked with that employer.

Can my employer make me use vacation first?

Since January 1, 2025, employers can't require you to use vacation before PFL.

Why did HR only mention 12 weeks?

HR is only required to explain the federal minimum. Many HR teams don't know how California's programs stack either.
